CNR presentation:

The National Road Committee (hereafter the "CNR") is a professional economic development committee whose missions are mainly the observation and monitoring of the economic aspects of the road freight transport market, in particular through the analysis of costs, the carrying out and dissemination of research and studies relating to the said market.

The CNR provides users with the present Web Site, accessible at the address https://www.cnr.fr, whose conditions of access and use are governed by the present General Conditions of Use.

Definitions :

« Terms of Service or TOS ».means the provisions set forth herein governing access to and use of the Site and its Services.

« Data » refers to all information communicated by the User during his visit, as well as any element collected automatically through the Site during his visit, and used for the purpose of improving the Site.

« Site » refers to the CNR Web Site located at the URL address "www.cnr.fr", all the pages of the said site.

« Services » means the services offered by the CNR on its Site.

The Services include free services as well as paid services, it being specified that the latter are subject to general terms and conditions of sale (hereinafter "GTCS") accessible from the following link: GTCS

« User » refers to any legal or natural person, located on the territory of the European Union, visiting the Site « www.cnr.fr », as well as all the pages of the said Site.

           

Article 1 - Purpose

1.1. The purpose of these General Conditions of Use is to define the terms and conditions of use of the Site and the Services available on the Site that the CNR makes available to the Users, as well as the relationship between the CNR and the Users; this Site and the Services being reserved for Users located within the European Union.

Browsing on the Site automatically entails the User's full and unreserved acceptance of these GTCU.

The applicable GTCU are those in force at the time of each navigation of the User to the Site. Consequently, the User is invited to read the Terms and Conditions of Use each time he visits the Site.

These GTCUs can be modified at any time by the CNR as necessary. In this case, the User acknowledges that his use of the Site after modification of the GTCUs will automatically imply acceptance of the GTCUs thus modified.

1.2. If a User uses the Site on behalf of an entity (e.g., association, company, foundation), he guarantees that he holds all the necessary authorizations to accept the GTCU on behalf of the entity for which he uses the Site. In this case, his access to the Site will also entail unreserved acceptance of the GTCU by the entity in question.

 

Article 2 - Description of the site

The Site provides access to various Services made available by the CNR.

In particular, it provides access to the following Services: 

  • The provision of indices and statistics ; 
  • Publications on various subjects; 
  • The newsletter of the CNR;
  • Simulation tools (in particular, tools for calculating price indexation or the cost simulator of a road freight transport vehicle);

Article 3 - Subscription to the newsletter

The Site allows Users to subscribe free of charge to the CNR newsletter by communicating their e-mail address.

By subscribing to the newsletter, the User receives a subscription confirmation e-mail containing a hypertext link to the CNR Website.

The User may request cancellation of his subscription at any time. E-mails sent by the CNR due to a subscription to the newsletter contain a link entitled "unsubscribe" allowing the User to unsubscribe. It is also possible for the User to formulate the unsubscription request by e-mail at the following address: cnr@cnr.fr.

 

Article 4 - Personal data 

Personal data

The CNR is required to collect and process the User's personal data. 

The CNR complies with the applicable legislation regarding the protection of Users' personal data and with Law No. 78-17 of January 6, 1978 relating to computers, files and freedoms, as amended by Law No. 2018-493 of June 20, 2018, and Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the Protection of Individuals with regard to the Processing of Personal Data and on the Free Movement of such Data (GDPR).

The CNR may wish to implant cookies in the User's computer in order to facilitate and improve its navigation on the Site.

Article 5 - Declarations and Obligations of the User

By accessing the Site, the User undertakes to comply with the laws and regulations in force.

The User acknowledges:

- Be aware of the principles underlying the operation of the Internet and electronic communication networks and accept its characteristics and limitations;

- Be aware that the NRC cannot exercise any control over the nature and characteristics of the data accessible on the Internet and that, consequently, the NRC cannot assume any liability arising directly or indirectly from such data;

- Be aware that data circulating on the Internet cannot be completely protected against possible misappropriation and that any communication is made at the User's own risk. Indeed, the CNR implements appropriate technical measures designed to protect data against accidental loss or unauthorized access or dissemination.

However, the Internet remains an open system and NRC cannot guarantee that unauthorized third parties will not be able to override these measures and access the data.

- Be aware of the fact that viruses can be introduced by third parties on the Internet and therefore acknowledges that it is its responsibility to take all appropriate measures to ensure the protection of data stored on its computer equipment; 

By using the Site, the User assumes the risks relating to the completeness, accuracy or timeliness of the information on the Site that he or she uses, at his or her own risk and under his or her responsibility. 

The User guarantees the CNR and its partners against any recourse or action by any third party, and their possible pecuniary consequences, arising from the use of the Site by the User or from the violation by the User of the Terms and Conditions of Use, the Terms and Conditions of Sale, the Policy relating to personal data and cookies or the regulatory provisions in force.

As such, it undertakes not to use any software, applications, or technical means enabling it to interfere with the normal operation of the Site and Services as provided for in the Site's TOS and GTCS.

The User must take care to respect the operation of the Site and the technical measures used to ensure the security of the Site and access to the Site.

Any violation of these TOS may be punished both civilly and criminally.

 

Article 6 - Access to the site :

The CNR strives to allow access to the Site 24 hours a day, 7 days a week, except in the event of force majeure, as defined by Article 1218 of the French Civil Code and by French case law, and also subject to possible breakdowns and maintenance or upgrading of the Site, without these interruptions giving rise to a right to compensation for the User.

The CNR may not be held liable when access to the Site is interrupted or impeded due to the quality of the Internet and electronic communication networks. 

In addition, the User accepts that the CNR may have to interrupt the Site and all or part of its Services at any time and without notice.

The CNR shall not be held responsible in the event of impossibility of access to the Site and/or use of the Services, the Users waiving any claim or action in this respect.

In addition, Users undertake to inform the CNR of any behaviour that may result in the interruption of access to the Site.

Article 8- Hypertext links :

8.1 Links from the Site to third party sites :  

The Site may propose to the User to use hypertext links leading to other websites. Linking the Site to these sites is deemed to provide additional qualified information. Under no circumstances can the CNR be held responsible for the content of these sites that it does not publish, and which may evolve, the User acknowledging that these sites and services of third parties or partners are completely independent of the CNR. The proposed redirection to a third party site is not a recommendation and the CNR is in no way responsible for the editorial content proposed in the sites concerned, the consultation of these sites being under the sole responsibility of the User. 

8.2 Links from third party websites pointing to the CNR Website: 

By creating one or more hypertext links pointing to the Site, the User undertakes not to modify the content and information on the Site or to alter the Services. (e.g.: additions, cuts, editing, substitutions, extractions, advertising, etc.).

Regardless of the type of hypertext link pointing to the Site, the User is not authorized to set up a mechanism for the systematic referencing of all or part of the information and content present on the Site for any reason whatsoever and in particular in order to offer a service to the public, in particular for commercial purposes, without the prior written authorization of the CNR.

 

Finally, third party sites pointing to the CNR Site may under no circumstances disseminate illegal content (e.g.: apology for crimes against humanity, child pornography, incitement to racial hatred or violence or undermine the dignity of a person or group of persons) or harm the image of the CNR.

 

Article 9 - Intellectual property :

The Site is an indissociable whole. The information contained therein is reserved for exclusively personal use and may not be reproduced, in whole or in part, or communicated to third parties for any reason whatsoever. 

The CNR is the exclusive owner of all intellectual property rights relating to the content (such as texts, graphic charter, visuals, sounds, images, photographs, domain name, logo(s)) appearing on the pages of the Site or has been granted licenses as such.

Likewise, it is the exclusive owner of the structure of the Site. 

Any reproduction, representation, distribution or exploitation, of any nature whatsoever, in whole or in part, of the content of this site and on any medium or by any means whatsoever, for purposes other than personal use, is prohibited without the prior consent of the CNR. 

Failure to comply with this prohibition constitutes an infringement within the meaning of Articles L.335-2 et seq. of the Intellectual Property Code, which may result in the civil and criminal liability of the infringer.

 

Article 10 - Limitation of liability :

The information contained in the Site is provided for information purposes only and the Services and the Site are provided as is. As such, they may not engage the responsibility of the CNR, which gives no guarantee, explicit or implicit, and assumes no responsibility relative to the use of this information, the Services or the Site. 

The User acknowledges that the CNR may not be held liable for any direct or indirect damage, and in particular material damage, immaterial damage, loss of data or programs, financial damage, resulting from access, impossibility of access or use of the Site or any sites linked to it or from the fact, in particular, of the interruption, suspension, modification or abandonment of the Site or one of its elements.

Moreover, the CNR cannot be held liable in case of inaccessibility of the Site, particularly during maintenance periods or in case of force majeure.

In addition, the CNR does not guarantee the completeness, timeliness and relevance of the information disseminated on the Site.

The User is advised that CNR will provide any information that enables or facilitates the identification of any person who has violated the law or infringed the rights of CNR or a third party at the request of an authority or jurisdiction, such as IP addresses and connection times.

In the event that the CNR's liability is judicially sought due to a breach by a User of the obligations incumbent upon it, the CNR may call upon the latter as a guarantee.

The User acknowledges that he/she is solely responsible for the use of the Site, the information and the Services accessible via the Site.

 

Article 11 - Applicable law :

Both this Site and its Services and the terms and conditions of their use are governed by French law, regardless of where they are used.

If any of the provisions of these TOS is deemed null or void by any authority or jurisdiction, it will be deemed unwritten and will not invalidate the other provisions which will remain in force.

 

Article 12 - Jurisdiction :

Any dispute resulting from the use of this Site and the paid Services it offers or from the distribution of the information it contains will be under the exclusive jurisdiction of the Courts of Paris applying French Law.
